How AI copyright lawsuits could make the whole industry go extinct

The New York Times (NYT) filed a lawsuit against Microsoft and OpenAI on December 27, 2023, alleging that OpenAI unlawfully used its articles to create AI products. The newspaper claimed that OpenAI emphasized Times content in training generative AI tools like ChatGPT. The lawsuit argues that OpenAI attempted to “free ride on the Times’s massive investment in its journalism” by using millions of copyrighted news articles, investigations, opinion pieces, reviews, and guides. OpenAI responded to the allegations in a blog post on January 8, 2024, stating that the “NYT lawsuit is without merit”. The case is significant as it differs from other cases involving AI and copyright, such as the case brought by Getty Images against Stability AI earlier in 20231.
